1. About Us and Our Role

CheapFlyShop.au is operated by Flightease Australia Pty Ltd (ABN 36 684 645 181), an Australian private company with its registered office at 232 Unley Road, Unley SA 5061, Australia.

We are an independent online travel agency. We act solely as a booking intermediary / agent. We do not operate aircraft. We arrange tickets through a network of suppliers and consolidators. Tickets are issued under the ticketing authority of those suppliers or the operating airlines.

Your contract of carriage is with the operating airline(s). We collect payment from you and arrange ticket issuance on your behalf.

Prices on cheapflyshop.au are generally displayed in Australian dollars (AUD) unless otherwise indicated.

2. Booking Process, Lead Prices and Confirmation (Critical Section)

2.1 Nature of Displayed Prices

Many of the fares shown on our website are lead-in, promotional, or undercut prices sourced from suppliers and consolidators. These fares are highly dynamic and can change or be withdrawn by the airline or supplier at short notice. The display of a price on the website does not guarantee that the same fare will still be available when we attempt to ticket the booking.

2.2 48-Hour Review and Confirmation Period

After you submit an online booking request and payment is taken or authorised, we require a period of up to forty-eight (48) hours to review and attempt to confirm the booking with our suppliers. During this review period:

  • We check live availability and the exact current fare with the relevant supplier or airline.
  • If the original lead/promotional fare is no longer available, cannot be ticketed, or has changed, our representative will contact you and offer the nearest available alternative option(s).
  • Any alternative option may have a different price (higher or lower) and different conditions (including baggage, change, or cancellation rules).
  • You are under no obligation to accept any alternative offered.
  • If you do not accept the alternative offered (or if we are unable to contact you within a reasonable time), we reserve the right to cancel the booking request and refund any amount we have charged you for that booking (subject only to any non-refundable third-party fees that may already have been incurred, which we will disclose if applicable).

2.3 When a Binding Booking Exists

An order summary, payment receipt, or acknowledgement email is not final confirmation of a specific flight or fare. A binding booking for a specific itinerary and fare exists only when we issue a final confirmation email containing the e-ticket or the airline booking reference (PNR). Until that point, no contract for the specific advertised lead fare is formed.

2.4 Right to Cancel and Refund

If, during the review period, the original fare cannot be secured and you decline the alternative(s) offered, or if we determine that the booking cannot be completed, we will cancel the request and refund the amounts we have collected from you for that booking (less any disclosed non-refundable third-party charges, if any). This is our primary remedy and your primary remedy in such situations.

3. Accuracy of Passenger and Booking Details

It is your sole responsibility to ensure that every passenger name exactly matches the name on the passport or government-issued photo ID, and that all dates, routes and other details are correct.

Once tickets are issued, name changes are generally not permitted by airlines. Errors can result in denied boarding with no refund.

Please check your confirmation carefully and notify us of any error as soon as possible (ideally on the same day the booking is made).

4. Payment

Full payment is normally required at the time of the booking request. We accept major credit and debit cards and other payment methods shown on the website.

Prices are generally displayed and charged in Australian dollars (AUD). Your card statement may show a charge from CheapFlyShop, Flightease Australia Pty Ltd, or our payment processing partner.

We reserve the right to cancel a booking if payment is declined, if card details are incorrect, or if we cannot complete required fraud or verification checks.

We may request additional documentation (for example proof of identity or card ownership) before issuing tickets.

All prices include applicable taxes and fees known at the time of quoting, unless otherwise stated. Additional airline or airport charges (for example baggage, seat selection or change fees) may apply and are usually payable directly to the airline.

5. Tickets, Changes, Cancellations and Refunds

Most airline tickets are non-refundable, non-changeable and non-transferable unless the specific fare rules state otherwise. Fare rules are set by the airline and apply in full once the ticket is issued.

Any request to change or cancel must be made through us (02 9000 9002 or support@cheapflyshop.au). We will submit the request to the supplier/airline.

Applicable airline penalties, fare differences and any service fees will apply.

Where a refund is due from the airline, we will process it after we receive the funds (this commonly takes 8–12 weeks or longer).

Schedule changes, cancellations, delays and operational decisions are the responsibility of the operating airline.

6. Baggage – Strict Policy (Please Read Carefully)

Baggage allowances are determined solely by the airline and by the specific fare type purchased. They are not determined by CheapFlyShop.

Important:

A large and growing number of airline fares (especially Basic, Light, Saver and Promotional fares) include no free checked baggage and often only a small personal item that must fit under the seat.

A standard cabin/carry-on suitcase is frequently not included and must be purchased separately as an optional extra.

Even when a cabin bag is permitted, airlines enforce strict size and weight limits. Bags that exceed these limits are regularly charged at the airport at significantly higher rates or may be refused entirely.

  • You must check the exact baggage allowance shown on your e-ticket and in the fare conditions before you pack.
  • Measuring and weighing your bags at home is strongly recommended.

CheapFlyShop and Flightease Australia Pty Ltd accept no responsibility or liability for:

  • Additional baggage charges imposed by the airline.
  • Excess baggage fees.
  • Gate charges.
  • Denied boarding arising from excess or non-compliant baggage.

These matters are solely between you and the operating airline.

7. Limitation of Liability

Because we act only as an intermediary:

  • We are not liable for the acts, omissions, negligence or performance of any airline, hotel or other supplier.
  • Your remedies for flight disruptions, baggage issues, denied boarding, delays or cancellations lie primarily with the operating airline under its conditions of carriage and applicable law (including the Montreal Convention where it applies).
  • We accept liability only for our own proven negligence or material misrepresentation in performing our agency services, and only to the extent permitted by applicable Australian law.
Nothing in these Terms excludes, restricts or modifies:

Any consumer guarantee, right or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted or modified by agreement.

Subject to the above and to the Australian Consumer Law, our total liability to you arising out of or in connection with any booking shall not exceed the total amount you paid to us for that booking.

8. Passports, Visas and Travel Documents

You are solely responsible for ensuring that every passenger holds a valid passport, any required visas, transit visas and other entry/exit documents for the destination and all transit points.

Requirements change frequently.

Important:

Australian travellers should consult official advice from the Department of Foreign Affairs and Trade (Smartraveller – smartraveller.gov.au) and the relevant embassies or consulates.

We accept no liability for denied boarding, refusal of entry, or any resulting costs arising from incorrect, incomplete or missing travel documents.

9. Special Requests, Assistance and Meals

Special requests (meals, seats, wheelchair assistance, etc.) are requests only. We will pass them to the airline but cannot guarantee that they will be fulfilled.

You should confirm directly with the airline.

  • Wheelchair assistance
  • Medical assistance
  • Infant travel arrangements

Pregnancy, infant and medical travel rules are set by the airline; you must check and comply with them.

10. Website Accuracy and Pricing Errors

We make reasonable efforts to keep information and prices accurate. Because airline inventory and fares change rapidly, occasional errors can occur.

Fares are not guaranteed until a ticket is issued.

Important:

We reserve the right to cancel or amend a booking if a clear pricing error has occurred.

In that case you will be offered the correct price or a refund of amounts paid to us for that booking.

11. Events Beyond Our Control

We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including:

  • Airline strikes
  • Severe weather conditions
  • Natural disasters
  • Pandemics
  • War
  • Terrorism
  • Technical failures of third-party systems
  • Government actions

12. Complaints and Australian Consumer Law

If you have a complaint, please email support@cheapflyshop.au with the subject line "Complaint – [Booking Reference]" and full details.

We will investigate and respond as soon as reasonably possible.

Operational issues (delays, baggage, denied boarding, etc.) should be directed to the operating airline in the first instance.

Nothing in these Terms is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law. If you are a consumer, you may have guarantees and remedies that cannot be excluded.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of South Australia, Australia.

Subject to any mandatory rights you may have as a consumer under the Australian Consumer Law or other applicable legislation, the courts of South Australia shall have non-exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your booking.

14. Changes to These Terms

We may update these Terms from time to time.

The version in force at the time of your booking request will apply to that booking.

Continued use of the website after changes constitutes acceptance of the updated Terms.
